Summary

Hydropal helps you understand and track your daily hydration, caffeine, and alcohol intake. It’s designed for general wellness and lifestyle use — not as medical advice. By using Hydropal, you agree to these terms, so you should read them carefully.

1. Acceptance of Terms

By downloading, installing, or using Hydropal (the “App”), or the website at gethydropal.com (the “Website”), you agree to be bound by these Terms of Service (the “Terms”) and all applicable laws and regulations. If you access the App through your Apple ID, your use of Hydropal is also subject to Apple’s App Store Terms and Conditions.

When we say “Hydropal,” “we,” “our,” “us,” or “the developer,” we mean Francesco Compagnoni, the app’s developer and publisher.

We may update these Terms occasionally. Continuing to use Hydropal means you accept any changes.

2. License

Hydropal is licensed, not sold.

You receive a non-transferable license to use Hydropal on any Apple-branded device you own and control, in line with Apple's Usage Rules. Hydropal may also be used by other accounts linked through Family Sharing or volume purchasing if these features are enabled by us.

These Terms form an agreement between you and us — not Apple. Apple isn’t responsible for the app, its content, or its operation.

3. Use of the App and Website

  • Hydropal is intended for personal, non-commercial use.
  • You must use Hydropal lawfully and in accordance with these Terms.
  • Hydropal is not directed to children under 13, and users must have the legal capacity to enter into this agreement in their country.
  • You may create a local profile on your device. This data stays on your device and can optionally be synced via iCloud if enabled.
  • The App may not function properly if your device is jailbroken, rooted, or modified.
  • We reserve the right to suspend or discontinue Hydropal at any time.

You’re responsible for complying with any relevant third-party agreements when using the App (for example, your wireless data agreement or Apple Health terms).

4. Health and Wellness Disclaimer

Hydropal is a lifestyle and informational tool only. It does not provide medical advice, diagnosis, or treatment. Always listen to your body and consult a qualified healthcare professional before making significant changes to your fluid intake or health habits.

Hydropal’s hydration recommendations are estimates based on general formulas. They may not suit every individual, and we make no guarantees about accuracy, completeness, or fitness for any particular purpose.

Hydropal does not take into account personal health conditions, medical requirements, age, fitness level, medications, or any other factors that may affect your hydration needs.

By using Hydropal, you agree that you do so at entirely at your own risk, and that the developer is not responsible for any health consequences caused by your use of Hydropal.

5. Subscriptions and Purchases

Hydropal offers optional Pro features available via Apple’s in-app purchase system on a monthly or yearly basis.

  • Billing, renewals, and cancellations are managed by Apple, not by Hydropal directly.
  • You can manage or cancel your subscription in your App Store account settings.
  • Refunds are subject to Apple’s policies.
  • We may modify the features or pricing of Hydropal Pro at any time; any changes will take effect after your current billing period unless otherwise required by Apple.

If the App ever fails to meet a warranty that cannot legally be disclaimed, you may notify Apple, and Apple will refund the purchase price. Beyond issuing the refund, Apple has no warranty obligations.

6. Data and Integrations

Hydropal connects to Apple Health (HealthKit) to provide a better hydration experience.

  • With your permission, Hydropal can read your activity data (e.g. active calories) and write your water, caffeine, and alcohol consumption to Apple Health.
  • You can control these permissions at any time in your device’s Health settings.
  • Hydropal does not share your HealthKit data with third parties.

Hydropal uses PostHog Analytics to understand general app usage and improve the product. Data collected through PostHog is anonymous and non-personal, linked only to a random installation identifier.

7. Intellectual Property

All content, code, images, branding, and design within Hydropal and the Website are owned by Francesco Compagnoni and are protected by intellectual property laws. You may not copy, modify, reverse-engineer, or distribute any part of Hydropal except as permitted by law or under an open-source license explicitly referenced within the App.

If any third party claims that Hydropal infringes their intellectual property rights, we—not Apple—are responsible for handling the investigation, defence, settlement, and resolution of that claim.

8. Maintenance and Support

We are solely responsible for providing maintenance and support for Hydropal. Apple has no obligation to provide any maintenance or support services.

9. Product Claims

Any claim by you or a third party relating to your use of Hydropal—whether product liability, regulatory compliance, consumer protection, privacy, or issues related to HealthKit—must be addressed by us, not Apple. These Terms do not limit our liability to you beyond what the law allows.

10. Legal Compliance

By using Hydropal, you represent and warrant that:

  • You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country.
  • You are not on any U.S. Government prohibited or restricted party list.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Hydropal is provided “as is” and without any warranty of any kind, express or implied.
  • We do not guarantee that the App will always be accurate, reliable, available, or error-free.
  • We are not liable for any injury, loss, or direct, indirect, incidental, or consequential damages resulting from your use of, reliance on, or inability to use Hydropal, including hydration or health-related outcomes.

Some jurisdictions do not allow certain liability exclusions, so parts of this clause may not apply to you.

12. Termination and Misuse

We reserve the right to suspend or discontinue the App, or your access to it, at any time if you misuse it, attempt to tamper with it, or violate these Terms.

We also reserve the right to change or remove features at any time.

13. Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by the laws of England and Wales. If any part of these Terms is found invalid, the remaining sections continue to apply.

14. Third-Party Beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of them, Apple has the right to enforce the Terms against you as a third-party beneficiary.

15. Language

If these Terms are translated into other languages, the English version will prevail in case of conflict.
